Acceptance of terms
By accessing or using ChartKit, you agree to these Terms of Service. If you do not agree, you must not use the service. This agreement is between you and ChartKit ApS (CVR 46291883), Ane Katrines Vej 14, 3. 3., 2000 Frederiksberg, Denmark. Business customers' processing of personal data is governed by the Data Processing Agreement at getchartkit.app/legal/dpa, which forms part of these terms.
Eligibility and accounts
You must provide accurate account information and are responsible for activity under your account. You agree to keep your account credentials secure.
License and acceptable use
We grant you a limited, non-exclusive, non-transferable license to use ChartKit for lawful business or personal use. You may not reverse engineer, resell, or misuse the service.
Subscriptions and billing
Paid features require an active subscription. Trial periods, pricing, and billing dates are presented at checkout and in your account dashboard. Subscriptions renew automatically for a period equal to the current term unless you cancel before the term ends, or, for annual business plans, unless either party gives written notice at least 30 days before the term ends.
Intellectual property
ChartKit, including software, branding, and content we provide, remains our intellectual property and is protected by applicable laws.
Disclaimer of warranties
ChartKit is provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of ChartKit.
Termination
We may suspend or terminate access for violations of these terms or misuse of the service. You may stop using ChartKit at any time.
Publicity
If you sign up for ChartKit, you agree that we may identify you or your organisation as a ChartKit user on our website and in marketing materials, including your name and logo. Email support@getchartkit.app to opt out and we will remove the reference.
Updates to terms
We may revise these Terms of Service from time to time. Continued use after updates means you accept the revised terms.
Governing law
These terms are governed by Danish law. Any dispute that cannot be settled amicably is subject to the exclusive jurisdiction of the Copenhagen City Court (Københavns Byret). Nothing in this clause limits mandatory consumer rights under applicable law.
